EQUIPMENT RENTAL TERMS & CONDITIONS
This Rental Agreement is between the Company identified on this agreement (“Lessor”) and the undersigned customer (“Lessee”).
By renting equipment from Lessor, Lessee agrees to the following terms:
1. Payment Terms
Payment is due at time of pickup unless Lessee has an approved credit account.
Customers with approved credit accounts will be billed according to their established credit terms.
For customers paying by credit card, Lessee authorizes Lessor to charge the card on file for rental charges, damages, cleaning fees, or other amounts owed under this Agreement.
2. Reservations & Cancellations
Equipment reservations are first-come, first-served unless prepaid.
Cancellations made at least 24 hours prior to the rental start time will receive a full refund.
Cancellations made within 24 hours of the start time may be subject to a one-day rental charge.
3. Rental Period
Rental begins at the “OUT” date and time and ends at the “IN” date and time listed on this agreement.
Rental charges continue until equipment is returned to our yard and inspected.
4. Equipment Condition at Pickup
All equipment is inspected and documented before leaving our yard using our fleet management system (Fleetio). Photos and condition reports are recorded at checkout.
At pickup, Lessee (or authorized representative) must:
Review the equipment
Confirm condition
Print and sign their name acknowledging inspection
If pre-existing damage is not noted at pickup, the equipment is considered accepted in documented condition.
5. Equipment Return Requirements
Equipment must be returned:
In the same condition as received (ordinary wear and tear excepted)
Clean and free of excessive dirt or debris
With all components and accessories intact
Tanks & Material Systems
All tanks, kettles, spray systems, and material containers must be returned completely empty.
If equipment is returned with material remaining in tanks or systems, cleaning and disposal charges will apply. These charges are based on actual labor time, disposal costs, and any additional service required to restore the equipment to rentable condition.
6. Damage Responsibility
Lessee is responsible for any damage occurring during the rental period beyond normal wear and tear.
If equipment or components are damaged, broken, or missing, Lessee agrees to cover the cost of:
Parts
Labor
Repairs
Replacement
Loss of use (if applicable)
All damage charges will be documented and supported by inspection reports and/or repair estimates.
7. Operation & Use
Lessee agrees to:
Operate equipment safely and lawfully
Ensure operators are properly trained and qualified
Comply with all local, state, and federal regulations
Use an appropriately rated tow vehicle when required
Equipment may not be removed from the State of Arizona without written approval.
If equipment becomes unsafe or malfunctions, Lessee must stop using it and notify Lessor immediately.
8. Licensing Requirements
If the work being performed requires a contractor’s license, Lessee must maintain the appropriate license. Lessor may request proof of licensure prior to release of equipment.
9. Environmental Responsibility
Lessee is responsible for any spills, releases, or environmental damage resulting from the use of the equipment.
10. Insurance & Liability
Lessee is responsible for the equipment during the rental period and assumes all risks associated with its use, transport, and operation.
Lessor is not responsible for incidental or consequential damages resulting from equipment use.
11. Late Payments
Past due balances may accrue interest at 1.5% per month (18% annually) or the maximum rate allowed by law.
Lessee agrees to pay reasonable collection and attorney fees if required.
12. Ownership
All equipment remains the property of Lessor at all times.
Failure to return rented equipment may result in legal action.
